I had an accident with my car (not my fault) and my car is a write off. I have been insured with the same company for the past 11 months and they called today to say that my car was previously a Category D write off (I was completely unaware of this). They say they may not pay out as they do not insure Category D write off's. Have I any rights since they have been accepting payment for the past 11 months?

I got swiped in the week. He is culpable and using his insurance Farmers. I get a rental while my car is in the shop. he's 23 and he just got a dui last night in cincinnati ohio and has nationwide (worst night of my life cuz i've never had a run in with cops before). he drives an old 95 civic and pays like 35 a month right now and he doesnt have any other marks on his record. also dont answer if you're going to judge, he could actually drive just fine but the cop was a jerk and wouldn't give me straight answers when i had questions and arrested him after he used the word perjury wrong in a sentence. he said you were doing great up until then . and he also condescended him in the car even though he had been cooperative the whole time. ps i have a new found hate for cops.

Car insurance -- should they cover these expenses?

I had an accident a month or two ago. It was in a rental car. I found out today that the insurance company had disallowed some of the charges that the rental company tried to pass to them. Now the rental company is trying to pass those charges to me. They ammount to about $500, plus my deductible, of course. The charges are $100 for an administrative fee $200.89 loss of use fee $139.38 diminished value fee. Who should pay these charges? Should I fork this money over to the car rental company? Should the insurance company pay them? What strategy should I use in my conversations with them? My feeling is that I have insurance, it should pay everything which is an actual cost above and beyond the deductible. ie if I have to pay it, the insurance company should have to pay it. On the other hand, if they are somehow bogus charges, then the rental company can eat it, and that's fine. Thought?

I don't have car insurance, but I have a driver's license. I am 16 years old living in Arkansas and I don't drive much. My parents have insurance and when they added me to the policy (of 2 cars), it went from $150 a month to $350, which we can't afford. We cancelled that insurance (with geico) and now have esurance, where my parents pay $135 monthly (with the same coverage), without me added. Should I be added on the policy, even though I don't drive much? If I'm driving and get in an accident, can I say that I was just burrowing my dad's car? Will I be covered under him then? About 5 months ago, my vehicle was hit in a parking lot leaving a big dent on the driver's side. The person who hit the car was kind enough to stay and contact his insurance company to file a claim. His insurance company appraised the damage, sent me a check, and told me it's mine to do with as I wish (I could keep it or use it for repairs). I decided to keep it and not repair my vehicle. Now, I'm looking at selling my car but I would like to repair it first to increase its value. Could I file a claim with my own insurance company since it was not my fault? Would I have to pay the deductible? The deductible is about $500 and the estimated damages from the previous appraisal was at $2500.
